6th Circuit: Clean Water Rule Jurisdiction Ruling ‘Is Going To The Supreme Court’

(December 14, 2015, 11:44 AM EST) -- CINCINNATI — During arguments on Dec. 8 about circuit court jurisdiction over the Clean Water Rule, judges in the Sixth Circuit U.S. Court of Appeals said that their decision will be guided by the circuit case law and that whatever decision the panel renders will probably be appealed to the U.S. Supreme Court (In Re: Murray Energy Corporation v. the Environmental Protection Agency, et al., No. 15-3751, 6th Cir.).
