Demoted Detective Asks High Court To Reverse Political Affiliation Ruling

(December 10, 2015, 11:43 AM EST) -- WASHINGTON, D.C. — The Third Circuit U.S. Court of Appeals erred when it determined that a detective who claims that he was improperly demoted because of a perception that he was involved in a political campaign may not proceed with his First Amendment claims because he was not actually engaged in any political association, the detective argues in a Nov. 16 brief filed in the U.S. Supreme Court (Jeffrey J. Heffernan v. City of Paterson, et al., No. 14-1280, U.S. Sup.).
