North Dakota Federal Court Won’t Stay Challenge To Clean Water Rule
Mealey's (December 10, 2015, 2:40 PM EST) -- FARGO, N.D. — A North Dakota federal magistrate judge on Oct. 10 denied the United States’ third motion to stay a states’ challenge to the Clean Water Rule, saying the administrative record should be produced and that a hearing in the Sixth Circuit U.S. Court of Appeals may not apply to a district court in another circuit (States of North Dakota, et al. v. U.S. Environmental Protection Agency, et al., No. 15-59, D. N.D.).
