Dismissal Of Bank’s Negligence Claims From Firm’s Breach Affirmed By 3rd Circuit

Mealey's (June 16, 2015, 4:41 PM EDT) -- PHILADELPHIA — A Third Circuit U.S. Court of Appeals panel on April 30 affirmed dismissal of a bank’s state law negligence and fraud claims against a billing firm whose data breach led to fraudulent withdrawals from patients’ accounts, with the panel finding that the bank failed to establish that it was owed any duty of care by the firm (Citizens Bank of Pennsylvania v. Reimbursement Technologies Inc., et al., No. 14-3320, 3rd Cir.; 2015 U.S. App. LEXIS 7149).
