Insurers Dispute Coverage For Suits Alleging Prescription Drug Abuse Scheme

Mealey's (December 9, 2015, 11:09 AM EST) -- SANTA ANA, Calif — Two insurers filed suit recently in a California court seeking a declaration that they have no duty to defend or indemnify a pharmaceutical company insured against underlying allegations that it knowingly and willfully participated in a systematic process of misleading doctors and patients as to opioids’ effectiveness and addictiveness to treat noncancer pain (Travelers Property Casualty Company of America, et al v. Actavis PLC, et al., No. 2014-00746842, Calif. Super., Orange Co.).
