Divided Panel Upholds Verdict Against Dental Practice For Sexual Assault

(December 8, 2015, 9:12 AM EST) -- ATLANTA — A Georgia Court of Appeals panel majority on Nov. 20 upheld a trial court’s judgment holding a dental practice 100 percent liable for an employee’s sexual assault on an anesthetized patient, holding that a jury properly considered matters of negligence and apportionment in its verdict (Goldstein, Garber & Salama LLC v. J.B., No. A15A1491, Ga. App.; 2015 Ga. App. LEXIS 758).
