Fracking Case Dismissed As ‘Predicated’ On ‘Theoretical Consequences,’ Panel Says

(December 7, 2015, 2:39 PM EST) -- ALBANY, N.Y. — An appellate panel in New York on Dec. 3 affirmed a trial court ruling that a water conservancy group’s declaratory judgment action against a state agency concerning its approval of permits for hydraulic fracturing was properly dismissed because it was “predicated on theoretical consequences” (Community Watersheds Clear Water Coalition Inc. v. New York State Department of Environmental Conservation, No. 520122, N.Y. Sup., App. Div., 3rd Dept.; 2015 N.Y. App. Div. LEXIS 8982).
