Federal Judge Refuses To Dismiss Professional Liability Coverage Dispute

Mealey's (December 7, 2015, 1:33 PM EST) -- GREENBELT, Md. — A Maryland federal judge on Dec. 3 denied an insurer’s motion to dismiss an insured’s breach of contract lawsuit, finding that until a factual record has been determined, the court cannot resolve whether the insured is attempting to use its professional liability coverage as a source to fund the ordinary cost of procuring services in its role as a general contractor on a construction project (Coakley & Williams v.
