Judge: Insured Failed To Show She Sued Original Tortfeasor In Bad Faith Suit
Mealey's (December 4, 2015, 11:36 AM EST) -- ANDERSON, S.C. — A federal judge in South Carolina on Nov. 24 dismissed an insurance breach of contract and bad faith lawsuit, ruling that an insured failed to show that she first sued an at-fault driver in an automobile accident before bringing claims against her insurer for underinsured motorist (UIM) benefits (Karen Lee Ecker v. Liberty Mutual Insurance Co., No. 15-4040, D. S.C.; 2015 U.S. Dist. LEXIS 158343).
