California Federal Judge: Disability Plan Does Not Include Retirement Standards
(December 3, 2015, 2:52 PM EST) -- SACRAMENTO, Calif. — A California federal judge on Nov. 17 determined that a disability plan does not require a firefighter, who was disabled while performing duties as a firefighter, to retire in any particular manner in order to collect a year’s worth of salary under Section 4850 of the U.S. Labor Code (David Barboza v. California Association of Professional Firefighters, et al., No. 08-519, E.D. Calif.; 2015 U.S. Dist. LEXIS 155488).
