TCPA Class Claims Against Cirque Du Soleil Survive Summary Judgment Motion
(December 3, 2015, 8:19 AM EST) -- CHICAGO — Claims over the sending of allegedly unsolicited faxes were tolled by two earlier, timely suits based on the Seventh Circuit U.S. Court of Appeals’ reasoning in Sawyer v. Atlas Heating & Sheet Metal Works, Inc. (642 F.3d 560 [7th Cir. 2011]), an Illinois federal judge ruled Nov. 12 (Practice Management Support Services, Inc., et al. v. Cirque du Soleil, Inc., et al., No. 14-2032, N.D. Ill.; 2015 U.S. Dist. LEXIS 152983).
