Magistrate Judge: Regional Water Board Is Not Indispensable Party

Mealey's (December 2, 2015, 12:12 PM EST) -- FRESNO, Calif. — A federal magistrate judge in California on Nov. 30 denied a public utility district’s motion to dismiss a Clean Water Act (CWA) lawsuit accusing it of violating its National Pollutant Discharge Elimination System (NPDES) permit by discharging excessive amounts of dichlorobromomethane (DCBM) into the Mariposa Creek, after finding that the California Regional Water Quality Board is not an indispensable party to the lawsuit (Friends of Mariposa Creek, et al. v. Mariposa Public Utilities District, No. 15-cv-00583-EPG, E.D. Calif.; 2015 U.S. Dist. LEXIS 161045)....
