Panel Affirms Convictions Despite Error In Exclusion Testimony On Eyewitness Identification
(December 2, 2015, 12:08 PM EST) -- LAKELAND, Fla. — Despite finding that a trial judge abused his discretion in excluding expert testimony regarding factors that may affect the reliability of eyewitness identifications, a Florida appeals panel on Nov. 25 affirmed convictions for two counts of first-degree murder and one count of attempted first-degree murder because the error was harmless (Jerry Tyrone Jones v. State of Florida, No. 2D13-3769, Fla. App., 2nd Dist.; 2015 Fla. App. LEXIS 17774).
