New York Law Governs Breach Of Contract Dispute, Federal Judge In Florida Rules
(December 2, 2015, 12:02 PM EST) -- FORT PIERCE, Fla. — A Florida federal judge on Oct. 26 held that New York law governs a breach of contract and bad faith dispute between an insurer and its manufacturer insured, rejecting the insurer’s argument that Florida’s exhaustion requirement applies (Wausau Underwriters Insurance Co. and The First Liberty Insurance Corp. v. Danfoss, LLC, No. 14-14420, S.D. Fla.).
