Oregon Appeals Court Reverses Dismissal Of State’s Motrin ‘Phantom Recall’ Lawsuit

(November 30, 2015, 2:05 PM EST) -- SALEM, Ore. — A panel of the Oregon Court of Appeals on Nov. 25 reversed dismissal of the state attorney general’s consumer law civil complaint against Johnson & Johnson and its McNeil Consumer Healthcare Division for the defendants’ “phantom recall” of defective Motrin brand ibuprofen (State, et rel. Ellen F. Rosenbaum, et al. v. Johnson & Johnson, et al., No. 527, Ore. App.; 2015 Ore. App. LEXIS 1410).
