Minnesota Supreme Court Finds Defect Claim Can Be Asserted Before Completion

(November 30, 2015, 12:02 PM EST) -- ST. PAUL, Minn. — The Minnesota Supreme Court on Nov. 23 affirmed an appellate court’s ruling that Minnesota Statute Section 541.051, subdivision 1, allows construction defect claims to be raised before substantial completion of a project but reversed its decision that a property owner failed to provide sufficient information about knowing of water infiltration issues more than two years before filing suit (328 Barry Avenue LLC v. Nolan Properties Group LLC, et al., No. A14-0724, Minn. Sup.; 2015 Minn. LEXIS 693).
