10th Circuit: It Is ‘Plausible’ That Prison Wardens Knew Water Was Contaminated

(November 30, 2015, 11:37 AM EST) -- DENVER — A panel of the 10th Circuit U.S. Court of Appeals on Nov. 25 partially reversed the dismissal of a contaminated drinking water lawsuit brought against Colorado prison officials by an inmate who contended that he was forced to drinking water containing toxins such as uranium, determining that there is as plausible claim that the wardens at the correctional facility were deliberately indifferent to the situation (James Roger Duncan v.
