California Appeals Court Tosses $1M Awarded For Loss Of Use From Remediation
(November 30, 2015, 10:20 AM EST) -- SANTA ANA, Calif. — A California appeals panel on Nov. 6 reversed a judge’s decision to adopt a referee’s finding that the buyer of a property that was subject to remediation after the purchase was entitled to $1 million in damages for loss of use, finding that the evidence did not support the amount (Hot Rods LLC v. Northrop Grumman Systems Corporation, No. G049953, Calif. App., 4th Dist., Div. 3; 2015 Cal. App. Unpub. LEXIS 8039).
