Appeals Court: Judge Erred When Finding Builder Violated Consumer Protection Law

(November 13, 2015, 12:25 PM EST) -- PHILADELPHIA — A Pennsylvania Superior Court panel on Nov. 10 ruled that a trial court judge erred when finding that a home builder violated Pennsylvania’s Unfair Trade Practices and Consumer Protection Law (UTPCPL) because the plaintiffs failed to show justifiable reliance (Dr. John D. Harding, et al. v. The Cutler Group Inc., d/b/a The David Cutler Group, No. 135 EDA 2015, Pa. Super.; 2015 Pa. Super. Unpub. LEXIS 4104).
