Coverage Barred For Fax Blast Class Action Suit, Illinois Panel Affirms
(November 11, 2015, 12:32 PM EST) -- ELGIN, Ill. — An Illinois appeals panel on Oct. 29 affirmed a lower court’s ruling that an insurer has no duty to defend and indemnify against an underlying class action lawsuit alleging that its restaurant insured faxed an unsolicited advertisement to more than 40 recipients (Illinois Casualty Co. v. West Dundee China Palace Restaurant Inc., et al., No. 2-15-0016, Ill. App., 2nd Dist.; 2015 Ill. App. Unpub. LEXIS 2436).
