California Federal Judge: Insurer May Have Duty To Defend Contamination Claims
Mealey's (November 10, 2015, 12:35 PM EST) -- SACRAMENTO, Calif. — A California federal judge on Nov. 5 granted an insured’s motion for summary judgment on the limited issue of the duty to defend after determining that it is possible that the contamination caused by the insured’s landfill could have been accidental (County of Stanislaus v. Travelers Indemnity Co., et al., No. 14-00666, E.D. Calif.; 2015 U.S. Dist. LEXIS 150550).
