Evidence Fails To Support Plan Beneficiary’s Claims, New York Federal Judge Says
Mealey's (November 9, 2015, 2:01 PM EST) -- NEW YORK — A health plan beneficiary failed to prove that the health plan fund was arbitrary and capricious in handling her claims for psychiatric treatment, a New York federal judge said Oct. 28 in denying the beneficiary’s motion for summary judgment and granting the plan’s motion for summary judgment (Wendy A. Tedesco v. IBEW Local 1249 Insurance Fund, et al., No. 14-3367, S.D. N.Y.; 2015 U.S. Dist. LEXIS 146247).
