Welfare Plan Is Governmental Plan, Exempt From ERISA, Louisiana Federal Judge Says
(November 9, 2015, 2:00 PM EST) -- NEW ORLEANS — Claims alleged under the Employee Retirement Income Security Act by retirees against an employee welfare plan cannot stand because the employee welfare plan is exempt from ERISA regulations because it is a governmental plan, a Louisiana federal judge said Oct. 23 in dismissing the retirees’ claims (Mary Smith, et al v. Regional Transit Authority, et al., No. 12-3059, E.D. La.; 2015 U.S. Dist. LEXIS 144192).
