Claimant’s Suit Is Not Time- Barred Under Missouri Law, 8th Circuit Panel Concludes

(November 9, 2015, 1:58 PM EST) -- ST. LOUIS — Because Missouri law provides a 10-year limitations period for suits arising under the Employment Retirement Income Security Act and a long-term disability plan provision deferred to the applicable state law’s limitations period, a disability claimant’s suit was not time-barred, the Eighth Circuit U.S. Court of Appeals concluded Oct. 21 (Brenda Mulholland v. Mastercard Worldwide, et al., No. 15-1211, 8th Cir.; 2015 U.S. App. LEXIS 18257).
