Pennsylvania Municipality: Company Lacks Standing To Oppose Fracking Ordinance

(November 9, 2015, 9:37 AM EST) -- PITTSBURGH — A Pennsylvania municipality sued by a hydraulic fracturing company that contends that a local ordinance banning fracking is “patently illegal” on Sept. 14 filed a brief in federal court contending that the company lack standing and the proper target for the lawsuit is the Pennsylvania Department of Environmental Protection (DEP) due to the way the permit process is being conducted (Seneca Resources Corporation v. Highland Township, Elk County, Pa., et al., No. 15-00060, W.D. Pa.).
