Amended Da Vinci Complaint Survives 2nd Dismissal, California Federal Judge Rules

(November 6, 2015, 2:05 PM EST) -- SAN JOSE, Calif. — A California federal judge on Nov. 4 said a plaintiff’s amended complaint involving a da Vinci surgical robot is not time-barred and sufficiently pleads facts to support punitive damages (Gerald Darringer, et al. v. Intuitive Surgical, Inc., No. 15-300, N.D. Calif.; 2015 U.S. Dist. LEXIS 150543).
