Federal Judge: Insurer Abused Its Discretion In Denying Long-Term Benefits Claim
(November 6, 2015, 11:40 AM EST) -- PHILADELPHIA — An insurer’s denial of long-term disability benefits was an abuse of discretion and arbitrary and capricious because the insurer’s denial was unsupported by a substantial lack of evidence, a Pennsylvania federal judge said Oct. 30 (Marvin Charles v. UPS National Long Term Disability Plan, et al., No. 12-06223, E.D. Pa.; 2015 U.S. Dist. LEXIS 147340).
