Long-Term Disability Plan Clearly Allowed For Offset, Ohio Federal Judge Says
(November 5, 2015, 11:54 AM EST) -- CLEVELAND — Because a long-term disability plan clearly allows for an offset of benefits, a disability insurer did not err in deducting a worker’s compensation disability award from a claimant’s long-term disability payments, an Ohio federal judge said Oct. 22 (Thomas Izzarelli v. The Lubrizol Corp. Long-Term Disability Plan, et al., No. 15-457, N.D. Ohio; 2015 U.S. Dist. LEXIS 143759).
