Kentucky Federal Judge: Disgorgement, Breach Of Fiduciary Claims Cannot Stand
Mealey's (November 5, 2015, 11:53 AM EST) -- LOUISVILLE, Ky. — A Kentucky federal judge on Oct. 22 dismissed claims of disgorgement and breach of fiduciary duty alleged against a disability insurer because the claimant alleges only that the insurer incorrectly processed a single claim and not that the insurer’s entire claims process is systemically flawed (Judith Gluc v. The Prudential Insurance Company of America, No. 14-519, W.D. Ky.; 2015 U.S. Dist. LEXIS 143628).
