Split 8th Circuit Panel Reinstates Trainer’s Race Bias, Retaliation Claims

LOUIS — A split Eighth Circuit U.S. Court of Appeals panel on Oct. 14 reversed a trial court’s rejection of a former U.S. Army contractor employee’s claim of racial discrimination and retaliation, finding that the employee had sufficient evidence to survive the employer’s motion for summary judgment (Melvin Smith v. URS Corporation, No. 13-3645, 8th Cir.; 2015 U.S. App. LEXIS 17832).
