Tribe, United States Dispute Equitable Tolling Ruling For Funding Claims
Mealey's (November 5, 2015, 8:15 AM EST) -- WASHINGTON, D.C. — With no extraordinary circumstances preventing a Native American tribe from filing contract claims within a six-year limitations period, the tribe is not entitled to equitable tolling for the claims, the United States argues in an Oct. 21 U.S. Supreme Court brief urging the court to affirm a circuit court ruling (Menominee Indian Tribe of Wisconsin v. United States of America, et al., No. 14-510, U.S. Sup.; 2015 U.S. S. Ct. Briefs LEXIS 3745).
