Man Tells 5th Circuit Insurer Was Improperly Granted Declaratory Judgment

Mealey's (November 4, 2015, 11:10 AM EST) -- NEW ORLEANS — A man who was sued by an insurance company seeking to avoid liability in an underlying lawsuit on July 2 filed a brief in the Fifth Circuit U.S. Court of Appeals, arguing that the district court erred when it held that the insurer was entitled to summary judgment regarding indemnity in the underlying case (Castle Point National Insurance Company, f/k/a formerly known as SUA Insurance Company v. Everado Chuca Lalo Jr., No. 15-10224, 5th Cir.).
