11th Circuit Reverses Dismissal Of Claim On Georgia Foreclosure Statute
(November 2, 2015, 1:14 PM EST) -- ATLANTA — The 11th Circuit U.S. Court of Appeals on Oct. 30 affirmed the dismissal of a claim for violation of the Fair Debt Collection Practices Act (FDCPA) asserted by former homeowners, but reversed a decision to dismiss their claim for declaratory judgment that Georgia's foreclosure statute is unconstitutional (Jean A. Saint Vil, et al. v. Perimeter Mortgage Funding Corporation, et al., No. 15-10347, 11th Cir.; 2015 U.S. App. LEXIS 18907).
