Cherokee High Court Asked To Decide Dispute Over Appellate Lawyer Fees

(October 28, 2015, 2:15 PM EDT) -- TAHLEQUAH, Okla. — Under Cherokee Nation law, a prevailing party in an action before the tribe’s Administrative Appeals Board (AAB) is entitled to an award of attorney fees not only for winning the case but also for defending a fee award on appeal, a member of the tribe who won a wrongful termination case against the tribe says in a July 20 Cherokee Nation Supreme Court brief (Doris Shell v. Cherokee Nation, No. SC-2013-01, Cherokee Nation Sup.).
