Justice: No Coverage For Restaurant’s Business Income Loss In Superstorm Sandy Dispute

(October 28, 2015, 1:26 PM EDT) -- NEW YORK — A New York justice on Oct. 14 held that an insurer owes no coverage for a restaurant insured’s alleged lost business income and stored food losses arising from a power outage in the wake of Superstorm Sandy, finding that the power outage was caused by flooding, which is excluded from coverage (La Casa Di Arturo Inc. d/b/a Arturo's v. Tower Group Inc., et al., No. 652606/2014, N.Y. Sup., New York Co.; 2015 N.Y. Misc. LEXIS 3744).
