3rd Circuit Vacates TCPA Class Ruling For Yahoo, Citing New FCC Definitions
Mealey's (October 28, 2015, 11:37 AM EDT) -- PHILADELPHIA — Citing a recent ruling by the Federal Communications Commission defining an “automatic telephone dialing system” (ATDS), as used in the Telephone Consumer Protection Act (TCPA), a Third Circuit U.S. Court of Appeals panel on Oct. 23 vacated and remanded a trial court’s finding that an automated text messaging system used by Yahoo Inc. did not violate the act (Bill H. Dominguez v. Yahoo Inc., No. 14-1751, 3rd Cir.; 2015 U.S. App. LEXIS 18460).
