9th Circuit: California Owes Tribe $36.2 Million For Incorrect License Calculation

(October 27, 2015, 9:40 AM EDT) -- SAN FRANCISCO — A California Native American tribe should be paid $36.2 million by the state for overpayments the tribe made for gaming licenses because the state misrepresented how many licenses were available, the Ninth Circuit U.S. Court of Appeals held Oct. 26 in affirming an award of summary judgment to the tribe (Pauma Band of Luiseno Mission Indians of the Pauma & Yuima Reservation v. State of California, et al., Nos. 14-56104, 14-56105, 9th Cir.; 2015 U.S. App. LEXIS 18635).
