No Defects Insurance Exists For Contractor Not Named On Policy, Federal Judge Says
Mealey's (October 26, 2015, 10:32 AM EDT) -- JACKSON, Miss. — An insurer has no duty to defend or indemnify a construction company against a construction defects lawsuit because the policy does not name the company as an insured but rather only the company’s founder, a Mississippi federal judge ruled Oct. 23 (Nationwide Property & Casualty Insurance Co. v. Jameilya Polk, et al., No. 14-136, S.D. Miss.; 2015 U.S. Dist. LEXIS 144305).
