Magistrate Judge Finds Couple’s Claims Against Builder Ripe For Arbitration
Mealey's (October 23, 2015, 11:42 AM EDT) -- OPELIKA, Ala. — A federal magistrate judge in Alabama on Oct. 21 granted a motion to compel arbitration filed by Grayhawk Homes Inc. after finding that the purchase agreement between the builder and the couple who purchased the home contained a clause that required them to arbitrate any claims over alleged construction defects (Sylvia Braggs, et al. v. Grayhawk Homes Inc., No. 15cv468, M.D. Ala.; 2015 U.S. Dist. LEXIS 142886).
