Washington Supreme Court Overturns City’s Water Permit On Public Interest Grounds

(October 22, 2015, 1:15 PM EDT) -- OLYMPIA, Wash. — In a 6-1 ruling, the Washington Supreme Court on Oct. 8 reversed approval by two agencies and a trial court of a municipal water permit, saying it did not meet the requirements for “overriding considerations of the public interest” (OCPI) under state high court precedent in a similar case (Sara Foster v. The Department of Ecology, et al., No. 90386-7, Wash. Sup.; 2015 Wash. LEXIS 1184).
