7th Circuit Reverses Dismissal Of Proposed Mortgage-Related Class Action

(October 22, 2015, 12:43 PM EDT) -- CHICAGO — Based on the recent ruling in Chapman v. First Index, Inc. (796 F.3d 783 [7th Cir. 2015]), the Seventh Circuit U.S. Court of Appeals on Oct. 21 reversed a trial court's decision to dismiss a borrower's claims for violation of the Telephone Consumer Protection Act and the Fair Debt Collection Practices Act (FDCPA) and her motion for class certification (Delia Webster v. Bayview Loan Servicing LLC, No. 15-1396, 7th Cir.; 2015 U.S. App. LEXIS 18295).
