Judge Orders Limited Discovery In Shareholder Derivative Lawsuit
(October 16, 2015, 7:51 AM EDT) -- BOSTON — A federal judge in Massachusetts on Sept. 22 denied a motion to dismiss filed by defendants in a shareholder derivative lawsuit, ruling that limited discovery is warranted because the defendants have raised serious questions as to whether an investor has properly pleaded demand futility and whether he is an adequate shareholder representative (Erwin Grampp, derivatively on behalf of JBI Inc. v. John Bordynuik, et al., No. 13-11906, D. Mass.; 2015 U.S. Dist. LEXIS 127665).
