Software Company Asks 5th Circuit To Restart SAP Trade Secret Suit

(October 15, 2015, 9:53 AM EDT) -- NEW ORLEANS — A software company asserts in an Oct. 5 brief that the Fifth Circuit U.S. Court of Appeal should revive a trade secrets ruling against SAP America Inc. and SAP AG (collectively, SAP) because SAP waived the right to have the matter resolved in a German court when it filed a declaratory judgment patent lawsuit against the software company in a Texas federal court (Wellogix, Inc. v. SAP America, Inc. and SAP AG, No. 15-20184 c/w 15-20187, 5th Cir.).
