Post-Denial Evidence Permitted Only To Calculate Damages Contract Breach

(October 9, 2015, 12:32 PM EDT) -- JOPLIN, Mo. — A disability claimant is permitted to present evidence of his ongoing disability only as it relates to calculating damages on the claimant’s breach of contract claim, a Missouri federal judge said Sept. 17 (Eric Millman v. Provident Life & Accident Insurance Co., et al., No. 14-5073, W.D. Mo.; 2015 U.S. Dist. LEXIS 124151).
