West Virginia Federal Judge Orders Insurer To Conduct Full And Fair Review Of Claim

(October 9, 2015, 12:35 PM EDT) -- CHARLESTON, W.Va. — A West Virginia federal judge on Sept. 29 remanded a claimant’s suit seeking long-term disability benefits to the insurer for a full and fair review of the claim and to determine whether and for what period of time the claimant was totally disabled after determining that the insurer did not provide the claimant with a reasonable explanation when it denied his claim (Gregory O’Dell v. Zurich Insurance Co., No. 13-12894, S.D. W.Va.; 2015 U.S. Dist. LEXIS 130831).
