Panel: Insureds Violated Notice Provision Of Title Insurance Policy

(October 9, 2015, 11:34 AM EDT) -- INDIANAPOLIS — A state trial court did not err in granting summary judgment to a title insurance provider in an insurance breach of contract and bad faith lawsuit because a failure by insureds to notify the insurer of an adverse claim against them violated the policy’s notice provision, an Indiana Court of Appeals panel ruled Sept. 28 (Michael R. Pike, et al. v. Conestoga Title Insurance Co., No. 16A05-1501-CT-27, Ind. App.; 2015 Ind. App. LEXIS 653).
