Judge: Widow’s, Expert’s Testimony Satisfies Causation Standard

Mealey's (October 8, 2015, 11:14 PM EDT) -- BENTON, Ill. — Both a widow’s personal recollections and expert testimony that fails to establish a baseline of permissible exposure are admissible, a federal judge in Illinois held Oct. 2. The judge also found that testimony that the decedent conducted dozens of brake jobs over almost two decades satisfies the causation standard (Mrs. Sharon Bell, executor of the estate of Mr. Richard Bell v. ABB Group Inc., et al., No. 13-1338, S.D. Ill.; 2015 U.S. Dist. LEXIS 135811).
