Portions Of Insured’s Bad Faith Claims Sound In Tort, Judge Rules
Mealey's (October 8, 2015, 11:18 AM EDT) -- KANSAS CITY, Kan. — A federal judge in Kansas on Sept. 23 partially dismissed insureds’ breach of the covenant of good faith and fair dealing claim against their insurer, ruling that portions of the insureds’ good faith and fair dealing claim sound in tort, which is not recognized in Kansas (Dr. Thomas C. Welton, et al. v. AMCO Insurance Co., No. 14-4066, D. Kan.; 2015 U.S. Dist. LEXIS 127726).
