Digging For Wind Farm Not ‘Mining’ Requiring A Federal Permit, Judge Rules

(October 7, 2015, 2:29 PM EDT) -- TULSA, Okla. — Allegations by the United States that the construction of a wind farm interfered with the Osage Nation’s reserved mineral rights and that the builders of the farm did not obtain the necessary prior approvals before excavating the turbine foundations for the project fail because the excavation work cannot be defined as “mining,” an Oklahoma federal judge held Sept. 30 (United States of America v. Osage Wind, LLC, et al., No. 14-cv-704, N.D. Okla.; 2015 U.S. Dist. LEXIS 132480).
