Federal Judge Dismisses Insureds’ Claims Against FEMA In Superstorm Sandy Dispute
(October 7, 2015, 11:59 AM EDT) -- CENTRAL ISLIP, N.Y. — A New York federal judge on Sept. 15 granted a motion by the Federal Emergency Management Agency to dismiss insureds’ breach of contract and nontort claims for lack of subject matter jurisdiction, further finding that the tort claims cannot survive because the insureds failed to exhaust administrative remedies before filing suit (Thomas Foster, et al. v. The Federal Emergency Management Agency, et al., No 14-1750, E.D. N.Y.; 2015 U.S. Dist. LEXIS 124636).
